IMMIGRATION

The student visa immigration law is designed to regulate the entry and stay of international students while ensuring they meet certain educational, financial, and legal standards. Students should be aware of the specific rules for their chosen destination and seek professional advice or guidance to ensure they comply with all visa requirements and conditions.

STUDENT VISA

A **student visa** permits international students to study abroad. Applicants must provide proof of admission, financial support, and sometimes language proficiency. The visa typically requires full-time enrollment and may limit work hours. Students must comply with visa conditions, such as leaving before expiration. Extensions can be requested, and post-graduation work opportunities may be available depending on the country.

The B1/B2 visa is a combined U.S. non-immigrant visa for temporary visits for business (B1) or tourism (B2). The B1 visa is for activities like attending business meetings, conferences, or negotiations, while the B2 visa is for leisure, visiting family, or seeking medical treatment. Applicants must demonstrate non-immigrant intent, financial stability, and a plan to return to their home country. The visa typically allows a stay of up to six months, with possible extensions. The application process involves filling out the DS-160 form, attending an interview, and providing necessary documentation at a U.S. embassy or consulate.

The H-1B visa is a U.S. non-immigrant visa that allows foreign workers in specialty occupations to work in the U.S. for a specific employer. To qualify, the applicant must have at least a bachelor’s degree or equivalent in a specialized field, such as IT, engineering, or medicine. The employer must file a petition on behalf of the worker, demonstrating a need for specialized skills. The H-1B visa is typically issued for up to three years and can be extended to a maximum of six years. It is a dual-intent visa, meaning holders can apply for permanent residency while on the visa.

The H-4 visa is a U.S. non-immigrant visa for the dependents (spouse and children under 21) of H-1B visa holders. It allows them to live in the U.S. while the primary H-1B visa holder works. The H-4 visa does not automatically grant the right to work, but certain H-4 visa holders may apply for work authorization if they meet specific conditions, such as if the primary H-1B holder has reached a certain stage in the green card process. The visa’s duration is tied to the H-1B holder’s status, and it can be extended accordingly.
